Terms of Service
The legally binding agreement between you and Cartlyf Technologies Limited.
1. The Platform's Role
FLYTS is a technology marketplace operated by Cartlyf Technologies Limited that connects car owners ("Hosts") with people who wish to rent vehicles ("Renters").
FLYTS offers two modes, chosen by the Host per car: Self-Drive (the Renter drives) and With Driver (the Host provides a driver).
Important: Cartlyf Technologies Limited is NOT a car rental company, a chauffeur service, or an insurer. We do not own, operate, insure, or drive the vehicles, and we do not employ the drivers. Every rental and driving agreement is formed directly between the Host and the Renter. FLYTS provides identity verification, listing verification and inspection, booking facilitation, and payment processing only.
2. Eligibility & Verification (KYC)
To use FLYTS, you must:
- Be at least 18 years of age.
- Provide accurate, current, and complete information during registration.
- Complete identity verification (National ID or Passport), which is reviewed and approved by FLYTS before you can book or list.
- Hold a valid driving licence only if you intend to self-drive (you selected "Self-Drive" or "Both"). Renters who only travel With Driver do not need a licence.
3. Booking, Payments & No-Deposit Policy
- No Security Deposit: Verified accounts are not required to pay a security deposit. Your account is secured by your verified identity.
- Payment: When a booking is confirmed, the full amount (rental fee + applicable service fee) is charged via Paystack.
- Host Wallet: Funds (less the FLYTS service fee) are credited to the Host's FLYTS wallet. Hosts may request a withdrawal in the app. Withdrawals are subject to processing and may be held or reversed in the event of a dispute, cancellation, or payment chargeback.
- Booking Control: Bookings are accepted or declined solely by the Host. FLYTS does not accept bookings on a Host's behalf and does not guarantee that any booking request will be accepted.
4. Condition Records (Mandatory Photos)
For every trip, both parties must upload clear photos of the vehicle (all sides, interior, fuel gauge, odometer) before handover and after return. Failure to upload these via the app may result in automatic denial of any related damage or fuel claim.
5. Prohibited Uses
You agree not to use any vehicle for:
- Off-road driving (unless the car is listed as 4x4 and approved).
- Ride-hailing or commercial sub-leasing (Uber/Bolt) unless authorised in writing.
- Racing or speed testing.
- Towing without Host consent.
- Transporting hazardous or illegal materials.
Breach may result in liability and removal from the platform.
6. Service Fees & Penalty Charges
FLYTS charges a service fee on each booking, shown transparently at checkout. The following penalty charges may be applied through the platform to protect Hosts:

7. Insurance & Liability — IMPORTANT
FLYTS does not provide insurance of any kind. FLYTS is not an insurer and offers no damage waiver, theft protection, or roadside-assistance programme.
- Hosts are solely responsible for maintaining valid motor insurance as required by Kenyan law and for confirming their policy permits rental use.
- Self-Drive: The Renter is responsible for the vehicle during the trip, including damage, loss, theft, traffic fines, and any excess, as agreed directly with the Host.
- With Driver: The Host/Driver is responsible for operating the vehicle, including accidents, collision damage, and traffic violations. The Renter remains responsible for interior damage caused by passengers and for their own belongings.
- Platform Immunity: To the maximum extent permitted by law, Cartlyf Technologies Limited is not liable for mechanical failure, accidents, theft, injury, loss, traffic violations, or criminal acts arising from any trip. Such matters are between Host and Renter.
8. Cancellations & Refunds
- Full Refund (100%): Cancelled more than 48 hours before the trip start.
- Partial Refund (85%): Cancelled 24–48 hours before the trip start.
- Reduced Refund (70%): Cancelled less than 24 hours before the trip start.
- Same-Day: Free cancellation within 30 minutes of booking; non-refundable after that.
Refunds are processed by FLYTS to the original payment method or wallet.
9. With Driver (Chauffeur) Specifics
- Driver Provision: The Host is responsible for providing a competent driver who holds the licences required by Kenyan law (including a PSV licence where applicable). FLYTS verifies the Host's identity but does not employ or independently certify third-party drivers.
- Liability: Liability for operation of the vehicle sits with the Host/Driver, not the Renter.
- Renter Responsibility: The Renter remains liable for any damage to the vehicle's interior caused by passengers and for ensuring the safety of their personal belongings.
- Operating Hours: Standard chauffeur service is up to 8 hours/day within town limits. Extra hours or out-of-town travel must be agreed and may incur additional charges through the platform.
10. Dispute Resolution
Disputes between a Host and Renter, or between a user and Cartlyf Technologies Limited, are first handled through mandatory mediation by FLYTS's Trust & Safety team. If mediation fails, disputes are resolved by the competent courts of the Republic of Kenya, with Nairobi as the venue.
11. Governing Law
These Terms are governed by the laws of the Republic of Kenya, including the Consumer Protection Act, 2012. Continued use of FLYTS constitutes acceptance of these Terms.
